Proceedings Summery Counsels on both side present. Counsel for plaintiff raised objection for the memo dt.05.08.2025 filed by the counsel for defendant. As seen from the record, admittedly the defendants did not vacate the entire schedule of property and that the keys that were deposited on 05.08.2025 along with the memo dt.05.08.2025 are not pertains to entire schedule of property. Therefore, filing of the said memo depositing the five keys pertains to part of schedule of property cannot be received by this court that too when the serious objection raised by the counsel for plaintiff. At this stage, the learned counsel for plaintiff submitted that, if the defendants vacates entire schedule of property and hand over the keys of entire schedule of property, the plaintiffs are ready to receive the keys without prejudice to rights of the plaintiff. At this stage, the learned counsel for defendants represented that the attachment which was effected is exceeding the just claim of the plaintiff and at this stage, if the defendants vacates the entire schedule of property, it would cause severe financial loss to the defendants which may go upto 10 times of loss to the defendants.
