Proceedings Summery Counsels on both side present. Defendants filed a petition under Order 38 Rule 9 R/W Sec.151 of CPC along with Board Resolution and a memo praying to remove/dischrage the attachment made under the order dt.25.03.2025. For check and put up the said petition. The State Bank of India (3rd party) already filed a petition under Order 38 Rule 8 CPC R/W Sec.151 of CPC in the section on 22.07.2025 praying to raise the attachment order dt.25.03.2025 in IA No.418/2025. For check and put up the said petition. At this stage, counsel for defendants No.1 & 2 requested to adjourn the matter to 05.08.2025, where as the counsel for plaintiff represented that since the defence of the defendant Nos.1 & 2 strike off by this court, the request of the counsel for defendant Nos.1 & 2 seeking long adjournment may not be considered and accordingly filed a memo to that effect. The counsel for defendant Nos.1 & 2 submitted that earlier the defendant Nos.1 & 2 have filed IA No.362/2025 to set aside the order dt.25.04.2025 passed in IA No.280/2025 and against the dismissal of the said order, the defendant Nos.1 & 2 are intending to prefer a revision. On considering the contents of both parties, this court is of the view to adjourn the matter to 05.08.2025 finally for filing and enquiry in two implead petition. Call on 05.08.2025.
