Proceedings Summery Counsel for plaintiff, D4 present. Advocate commissioner present and filed the report executing the warrant of commission of DW1 to DW4 enclosing the the cross-examination of DW1 to DW4 During the cross-examination in the commissioner report, the commissioner mentioned that Exs.A43 to A45 have been marked on confrontation through the respective witnesses. i.e., Exs.A43 & A44 were marked through DW1 in cross-examination in support of case of plaintiff, whereas Ex.A45 was marked through DW3 in support of case of plaintiff. The advocate commissioner filed a memo requesting for enhancement of the fee of commission by stating that it was taken four sittings for recording the cross-examination of DW1 to DW4. Heard the counsel for defendants regarding the enhancement of fee of commission as seen from the report, the cross-examination of witnesses was recorded at length which necessitated, the advocate commissioner to file for enhancement. On hearing the counsels on both side and advocate commissioner, the fee of commission is further enhanced for the sum of Rs.10,000/-, out of which Rs.5,000 to be payable by the D2 & D3 together and another sum of Rs.5000/- to be payments by the D4.
