Proceedings Summery Notice affixed on the notice board. Orders pronounced in the open court vide separate. IN THE RESULT, the petition is allowed as under: i) Sri G. Prashanth Reddy, Advocate is appointed as Advocate Commissioner for the purpose of repossessing the SCIEX QTRAP4500 SYSTEM from the custody of the respondent lying at its premises. ii) The Advocate Commissioner is directed to visit the premises of the respondent and repossess the machinery under proper identification by the authorized representative of the petitioner with the assistance of the technician provided by the petitioner. iii) The Adv., Commissioner shall hand over the custody of the machinery to the petitioner towards interim custody, till the completion of arbitration proceedings. The petitioner shall not have any right to transfer the machinery to any third party till completion of the arbitration proceedings. iv) The Adv., Commissioner is at liberty to take the assistance of the concerned police for execution of the order of this court. v)The fee of the Commissioner is fixed at Rs.10,000/- to be paid by the petitioner directly. vi) The Adv., Commissioner is directed to file his report before this court on or before 11.11.2022. vii) The petitioner is directed to initiate the arbitration proceedings within 90 days from the date of this order. viii) There is no order as to costs.
