Judgment pronounced vide separate One in the Open Court: In the result, the suit of Plaintiff is Partly decreed with Costs, granting Perpetual Injunction restraining the Defendants, their directors, employees, officers, servants, agents, subsidiaries, affiliates and all others acting for and on their behalf from making using, selling, distributing, advertising, exporting, offering for sale, and in any other manner, directly or indirectly, dealing in any product or process that infringes the claim subject matter of the Plaintiff’s Indian Patent No. 394568 or any of the claims thereof, including any suspo-emulsion formulation of Pyriproxyfen and Diafenthiuron in the range of 1-15% and 25-55% respectively. Further, the defendant Nos.1 and 2 each are directed to pay an amount of Rs.5,00,000/- (Rupees Five Lakhs only), total Rs.10,00,000/- (Rupees Ten Lakhs only) to the plaintiff towards Damages.
