Judgment pronounced vide separate one in the open court: In the Result, the suit of the plaintiff is decreed in part with proportionate costs for the relief granted and consequently, the defendant Nos.1 & 2 are jointly and severally directed to refund of the margin amount of Rs.27,14,000 (Rupees Twenty Seven Lakhs Fourteen Thousand Only) to the Plaitniff, with interest @ 12% per annum from the date of issuance of legal notice i.e. from 02.02.2019 till the date of this judgment and thereafter subsequent interest @ 6% per annum from the date of judgment till the date of realization, on the Principal sum of Rs.27,14,000/-. The suit claim of the plaintiff against defendant Nos.1 & 2 for a sum of Rs.8,00,000/- (Rupees Eight Lakhs Only) towards the two months rent for two excavatoars and another sum of Rs.1,00,00,000/- (Rupees One Crore Only) towards damages is dismissed.
