IA No. 169/2021 Heard the counsel for petitioners/plaintiff and the counsel for D1 to D3. the counsel for petitioners submitted that the Respondents D1 to D3 filed a suit against them in Delhi and they filed this suit against the Respondents D1 to D3 before this court both the matters all compromised and the Respondents had withdrawn the suit filed by them. They are also filing this petition to withdraw the suit is COS 5/2016 in view of the settlement of the matters between them. the counsel for Respondents D1 to D3 filed a memo reporting no objection for withdrawal of the suit by the plaintiffs. Hence considering the submissions of both counsel, the petition is allowed permitting the petitioners/plaintiffs to withdraw the suit keeping the questions of law raised relating to patents Act, 1970 and protection of plant varieties nd Farmers Rights Act, 2001 open.
