As per O-11 R-15 CPC, the party shall not afterwards be at liberty to put any such documents in evidence on his behalf unless he shall satisfy the court that he had some other cause or excuse which the court shall deem sufficient for not complying with the notice for production of the documents. The plaintiff herein has not given any sufficient explanation for not producing the said documents within the reasonable time. After closure of the plaintiff evidence, the said e-mails were confronted to DW.1 during the course of cross examination. Since there is no proper explanation by the plaintiff, for producing the documents at belated stage this court is not inclined to grant any leave to the plaintiff to mark the said documents as exhibits even for identification purpose and accordingly the point is answered against the plaintiff. The learned advocate commissioner is directed to complete the cross examination of DW.1 and file the complete report by 09.10.2023. Stage Of Case For Order
