CEA 164/24 The present application is filed to to set aside the exparte order dated 22.10.2024 on the ground that the petitioner’s counsel could not appear on the date of hearing on 22.10.2024 and the petitioner is not aware of the non appearance of the counsel and subsequently came to know about the same and steps were taken to file the present application to set aside the exparte order dated 22.10.2024. Having satisfied with the reason assigned by the petitioner, this court is inclined to allow the petition. It is well settled principal that the party should not be suffered due to the non appearance of the counsel. In the result, the petition is allowed. CEA 165/24 The present application is filed to condone the delay of 10 days in filing set aside application on the ground that the counsel could not appear on the date of hearing on 22.10.2024 and the petitioner is not aware of the non appearance of the counsel and subsequently came to know about the same and steps were taken to file an application to set aside the exparte order and the delay of 10 days was caused. It is well settled principal that the party should not be suffered due to the non appearance of the counsel. Hence this court to inclined to allow the petition.
