Proceedings Summery Call on 05.07.2023. I.A. 216/2023: contd.... as PW.1 and marked Ex.A1 to A.31 and some of the documents were not marked as they were not found in the record and the same is evident from the chief examination affidavit recorded on 05.10.2021. The present application is field to receive the annual report of the petitioner for the year 2010-11 and to mark the same in his evidence. The reason assigned by the petitioner is for filing the said document at this stage is that the document was mislaid during the course of transmitting the file from XXIV ACJ to Commercial Court and the petitioner suffered with Kidney infection during COVID – 19 and recently found the original document and the said document is very much crucial for deciding the case. The document produced by the petitioner herein along with the petitioner is not a new document and the photo copy of the same was filed along with the plaint and there is a specific pleading to that effect. If the document is received at this stage no prejudice would be caused to the respondent. Having considering the same this court is inclined to allow the petition and accordingly the petition is allowed and the document is received subject to proof, relevancy and admissibility 05.07.2023: I.A216/2023 is allowed.
