No. 684 and 685 /2022 are allowed on condition of payment of costs of Rs. 1000/- Advocate Sri Anand kumar Tiwari, is appointed as commissioner to record the cross examination of Pw.1 to 3 . Fees for recording of cross examination of PW.1 is fixed as Rs. 2500/- . Fees for recording cross examination of Pw.2 and 3 is fixed at Rs. 3,500/- each. The defendants shall bear costs of travel and accommodation expenditure of the commissioner. Warrant be issued. For report of commissioner, cal on 08.12.2022 I.A. 684/2022 and I.A. 685/2022: Counter filed. heard the both sides. Perused the record. The petitioner did not cross examined the witness and one of the reason for not cross examining the PWs 1 to 3 is that the M.D of the petitioner who was earlier representing the petitioner died and no more. The petitioner is not being represented by the new management could not get into contact with the counsel. Having considered all the facts and circumstances and in view of consent given by the counsel for the respondent, I allow the petitions to reopen the evidence and recall PW.s 1 to 3 on condition of payment of costs of Rs. 1000/-.
