Proceedings Summery IA.No.725/24 is dismissed. Orders pronounce in the open court (VSO). In the result, the petition is partly allowed and J.Sri Sairam (9589898993) is appointed as the advocate commissioner to determine the current status of the building, the extent of completed works, the extent of balance works of the said project in the schedule "Ä" property according to the construction contract dated 09.06.2023 and for taking physical measurement and noting down physical features of the entire building in schedule Ä"property, by giving notice to both parties. The petitioners and the respondent No.1 shall nominate one person each to assist the earned Advocate Commissioner while taking the measurements of the Schedule Ä"property. The learned Advocate commissioner is at liberty to take assistance of the certified Civil Engineer/Architect while taking the physical measurements and noting down the physical features of the entire building in schedule Ä"property, in the presence of both parties. The fees of the civil engineer/architect shall be payable by the petitioner. The learned Advocate Commissioner is directed to submit the report along within a period of six weeks from the date of this order and his fee is fixed at Rs.50,000/- which is payable by the petitioners.
