CEA 39/2023: contd........The petitioner company herein originally incorporated under the companies Act as M/s. Glochem Industries Ltd., on 20.01.1995 and the company name is changed to M/s. Glochem Industries Pvt. Ltd. Vide orders dated 07.07.2017 and the same is evident from the incorporation certificate filed by the petitioner company herein issued by the Govt. of India, Ministry of Corporate affairs. As on the date of passing the award, the petitioners company name was not changed and subsequently the name of the company changed on 07.07.2017 and the present CEP is filed in the name of Glochem Industries ltd. and the petitioner contended it is a typographical mistake and the private is inadvertently left out. Having considering submissions of both the counsels and verifying the record this court is inclined to allow the petition and the petitioner is permitted to amend the petitioner’s name from Glochem Industries ltd to Glochem Industries Pvt. Ltd in the execution petition and all other miscellaneous applications wherever necessary. The amendment will not change the basic structure of the execution petition and no prejudice would be caused to the judgment debtor. In the result the petition is allowed.
