Proceedings Summery Heard both sides. Perused the pleadings. Following issues are settled for trial. 1) Whether the risk suffered by the plaintiff i.e., “damages to the road works” due to floods is covered under the policy issued by the defendants (insurer)? 2) Whether the defendants are liable to indemnify the loss allegedly suffered by the plaintiff as per the terms and conditions of the insurance policy issued by them? 3) Whether the plaintiff is entitled to interest on sum, if any, recoverable by it from the defendants? If so, what shall be the rate of interest? 4) Whether the plaintiff is entitled to recover the sum amount of Rs. 2,37,63,771 with interest as claimed? 5) To what relief if any the plaintiff is entitled to? List of witnesses, interrogatories shall be filed by 28.02.2023 (as per case management order) and parties shall inform the court whether there is any possibility of settlement of dispute through ADR on the scheduled date.
