Proceedings Summery I.A.No. 517/2023 is allowed and statement of admissions and denials of defendants are taken on record. For hearing on case management call on 07.11.2023. I.A. 517/2023: The present application is filed by Defendant nos.1 to 4 U/o. 9 R.7 R/w. Sec. 151 CPC with a prayer to receive the statement of admission and denials by setting aside the order dated 14.11.2022. In support of the application the petitioner no. 4 filed an affidavit contending that the written statement and the documents were filed by the petitioner/ defendants and the statement of admissions and denials regarding the documents were not filed and the right was forfeited by this court on 14.11.2022 and contended that non filing is due to oversight and prayed to allow the petition. The respondent/ plaintiff has not filed counter but submitted oral arguments. Heard both sides and perused the record. The above suit is filed for recovery of money and the petitioners/ defendants herein filed written statement and failed to file the statement of admissions and denials and right was forfeited by the court on 14.11.2022. Having considering the submissions of both the parties, the petition is allowed by setting aside the order dated 14.11.2022 and statement of admissions and denials of the defendants herein is taken on record.
