Proceedings Summery The present CEP 11/2021 is filed for enforcement of arbitral award dated 27.02.2020. The JDR herein filed COP No. 29/2022 U/s. 34 of the Arbitration and Conciliation Act 1996 and the same is pending before this court in the said COP no. 29/2022 the JDR herein filed I.A.No. 472/2022 U/.s 36 (2) to stay the award dated 27.02.2020 and this court by order dated 04.04.2023 granted interim stay subject to depositing 50% of the amount awarded by the learned arbitral tribunal with interest within a period of 3 months from the date of the order. On perusal of the record, the 3 months is lapsed on 04.07.2023 and the learned counsel for the DHR submitted that the JDR has not deposited the amount in compliance with the order dated 04.04.2023 in I.A.No. 472/2022 in COP No. 29/2022. On 04.07.2023 when the matter was listed before this court, the learned counsel for the JDR sought for time for getting instructions and at his request the matter is adjourned to today i.e. 14.07.2023. There is no representation on behalf of the JDR till 4.45 p.m. In view of the non compliance of the order, this court has no other option except to proceed with the execution petition.
