I.A No. 88/2023:- Now the point for consideration is Whether the petitioner can be permitted to lead secondary evidence in respect of the two documents? Point 7. It is to be stated that the photostat copies are also served on the respondent as there is no response from the respondent. It is treated that the respondent has no objection to permit the petitioner to adduce secondary evidence in respect of above said two documents i.e, 1) Xerox copy of Agreement No.02/APMISDC/2015-2016 dt.17-04-2015 and 2) Xerox copy of supplemental agreement dated 27-09-2016. Hence the petition is allowed to grant permission sought for. 8. In the result, the petition is allowed. There is no order on costs. I.A No. 89/2023:- Whether the court can receive the documents mentioned in the petition? Point. 7. The contents of the affidavit in support of the petition remained uncontraverted. The documents in serial no.1 to 15 and the document in serial no.18 are original documents. The documents in serial no.16 and 17 are photostat copies. The admisiability of photostat copies will be decided during the course of trial. All the documents are received subject to proof, relevancy and admissibility. 8.
