The following issues are settled for Trial. 1) Whether the plaintiff is entitiled to reimbursement of Rs. 4,85,43,387 paid towards service tax for the construction activities undertaken by it for the defendant, as per contract? 2) Whether the plaintiff is entitled to recover taxes paid by it in respect of the contract work, as per the terms of the contract? 3) Whether the plaintiff is estopped from making the suit claim in view of discharge certificate issued by him at the time of settlement of account. 4) Whether the plaintiff is entitled to interest as claimed? 5) Whether the plaintiff is entitled to recover the suit claimed amount? 6) To what relief if any the plaintiff is entitled to?
