Proceedings Summery Order on first Case Management Hearing: Heard the counsel for the plaintiff on case management as per Order XV-A of the Code of Civil Procedure 1908, stated above the court makes the following order. There is no representation for the defendant. 1) Both the parties shall complete the inspection of documents under Order XI Rule 3 C.P.C. by 18.01.2023 and be ready for the trial. 2) Both the parties shall be present for hearing under order X Rule 1 and 2 C.P.C. on 01.02.2023 If parties fail to attend the , the Court will hear on issues on the same day, interrogatories if any shall be filed on that day. Issues will be settled on the same day. Written issues can be filed. 3) Both the parties shall inform the Court regarding possibility of settlement of the dispute through ADR (Sec. 89 of C.P.C) and file list of their witnesses on 22.02.2023. 4) The plaintiff shall file affidavits of evidence of all his/her/it's witnesses on 15.03.2023. after furnishing copies of the affidavits to other sides. 5) The recording of cross examination of all the witnesses of the plaintiffs shall be completed by 29.03.2023. In case of non compliance of the order on case management as stated above by the parties, the Court will exercise the discretion under order XV A. Rule 8 (a) to Rule 8 (c) C.P.C. Call on 18.01.2023.
