Proceedings Summery The learned counsel for the petitioner filed a memo stating that the Hon’ble High Court in Arbitration Application No.226/2024 appointed sole arbitrator to adjudicate the dispute between the parties and the parties have undertaken to appear before the learned arbitrator on 04.01.2025.The learned counsel for the petitioner and the respondents is present. The present COP is filed under Section 9 of the Arbitration and Conciliation 1996 seeking interim measures and this court by an order dated 01.05.2024 passed interim measures restraining the respondents from alienating the petition schedule flats in favour of third parties and the said interim order is extended from time to time. As per Section 9(3) of the Act, 1996, once the arbitral tribunal has been constituted, the court shall not entertain an application under Section 9 (1) unless the court finds that circumstances exists which may not render the remedy provided under Section 17 efficacious. In view of the constitution of arbitral tribunal, the petitioner has efficacious remedy under Section 17 of the Act to approach the learned arbitrator to seek interim measures. Having considering the same the interim order dated 01.05.2024 passed by this court is extended for a period of 4 weeks and in the meantime the petitioner is at liberty to take appropriate steps to seek interim measures before the learned arbitrator disposed.
