Proceedings Summery On perusal of the record. it is evident that the award is passed against M/s.SEW Infra structure Ltd., and even though the cause title of the CEP, it is described as M/s.SEW industries Ltd., the JDR filed vakalat on behalf of SEW Infrastructure Ltd, and contesting the CEP from 2022 onwards and also filed the several applications and counter affidavits and when the matter is posted for examination of JDR for disclosing its assets, the present application is filed taking the technical objection that the CEP is against M/s.SEW Infrastructures and not against M/s.SEW Infrastructure Ltd,. The JDR is aware that the award is passed against M/s.SEW Infrastructure Ltd, and having participating in the proceedings, the JDR is estopped from taking such stand at this belated stage and the application filed by the JDR is not bonafide. In compliance of the order dated 25.11.2024, the JDR did not appeared for examination and it is in clear willful disobedience of the order passed by this court. Order XXI Rule 41 (3) of CPC prescribes that the procedure for disobedience of the order passed by this court and having considering the same, this Court is inclined to issue show cause notice to JDR for disobeying the order dated 25.11.2024 passed by this Court as to why the JDR cannot be detained in civil prison for a term not exceeding three months.
