Proceedings Summery The DHR herein filed CEA 84 of 2022 for disclosure of assets of the JDR and the JDR filed the affidavit disclosing the assets on 28.11.2022 and in-view of the same, the CEA 84 of 2022 is closed on 19.12.2022. Since the assets disclosed by the JDR does not contain full particulars, the DHR filed CEA 49 of 2023 to direct the JDR’s to file fresh affidavit to disclose their assets under Order 21 Rule 41 CPC and the same is allowed by this court on 18.04.2023. The JDR filed the affidavit on 12.09.2023. The learned counsel for the DHR submitted that the affidavit filed by the JDR is not in accordance with the procedure contemplated i.e., Form-16-A of Appendix-E of CPC and all the particulars were not provided by JDR and relied upon the Judgment in M/s. Bhandari Engineers & Builders Pvt Vs. M/s. Maharia Raj Joining Venture 2016 SCC On-line Delhi 182. The learned counsel for the JDR submitted that affidavit disclosing the assets was filed on 28.11.2022 and on 12.09.2023 and the same are in-compliance with the order of this court. In view of the objection raised by the DHR, this court by an order dated 28.10.2024 directed the JDR to file the affidavit under Form 16-A of Appendix -E of CPC and posted the matter on 08.11.2024 and on 08.11.2024 at the request of JDR the matter is adjourned to today i.e., 25.11.2024 for compliance of order dated 28.10.2024. ...continue...
