Proceedings Summery The respondent Nos.1 & 2 filed a memo stating that the petitioner in the above COP filed Arbitration Application No.141 of 2024 before the Hon’ble High Court for the State of Telangana under Section 11(6) of the Arbitration and Conciliation Act,1996 for appointment of an arbitrator and the same was allowed on 19.07.2024 and Justice Sri.V.Ramasubramanian, former Judge of the Hon’ble Supreme Court of India, is appointed as Arbitrator to adjudicate the disputes between the parties and in view of the appointment of Arbitrator the present COP is not maintainable and also attached the copy of the order dated 19.07.2024 passed by the Hon’ble High Court. The memo is served upon the petitioners counsel. The learned counsel for the petitioner submitted that Section 9 application can be filed and entertained before or during the arbitral proceedings or at any time after making the arbitral award but before it is enforced in accordance with Section 36 of the Act, and submitted that the present COP is maintainable. Heard the learned counsel for the petitioner and the respondent No.6 and perused the record. The present COP.No.55 of 2024 is filed on 10.04.2024 under Section 9 of the Act, seeking the interim measures against the respondent Nos.1 to 4.
