Proceedings Summery On perusal of record, the evidence affidavit of DW.4 is filed on 22.01.2024. The learned advocate commissioner filed the report by recording the cross examination of DW.4. Heard the learned counsel for the plaintiff and counsel for defendant no.1 to 3 on the objection raised for marking the documents which were confronted to DW.3. The learned counsel for the plaintiff relied upon the judgment of Hon’ble Delhi High court in Gambhir and others Vs. Rama Arora dated 08.07.2022 contending that the documents confronted to the witness during the cross examination has to be necessarily placed on the court file whether such document is admitted or denied by the witness. The learned counsel for the defendant no.1 to 3 submitted that DW.3 during the cross examination has not admitted the confronted documents and the same cannot be marked as Exhibits. Having considering the same, the documents / emails confronted to DW.3 during the cross examination is placed on record and the admissibility of the said documents will be considered while passing the judgment.
