For marking of documents by PW.1, call on 26.07.2024 I.A.No.51/2024: The present application is filed by the plaintiff under order 11 rule 5 of commercial courts Act 2015 with a prayer to receive the original documents in the place of photocopies. In support of the application the authorised signatory of the plaintiff's filed affidavit contending that the above suit is filed for recovery of Rs.1,24,59,600/- and at the time of filing the suit the plaintiff filed the photocopies of the documents and the suit is coming up for trial and contended that the original documents were filed in the cheque bounce case and the counsel for the plaintiff obtained the documents and substituting the same and prayed to allow the petition. Notice of the application is served upon the defendant counsel and the learned counsel for the defendant reported no counter. Heard both sides and perused the record. The present application is filed to receive the original documents in the place of photocopies which were already filed by the plaintiff at the time of institution of the suit.
