I.A. 243/2023: contd........The present application is filed to receive the original balance confirmation copies dated 13-10-2020 and 11-01-2021 and on perusal of the record the above said photo stat copies are filed along with the plaint and there is a reference in the pleadings of the petitioner/plaintiff and the said documents are new documents and no prejudice will be caused to the respondents if they are received on record, though the provision under which the petition is filed mentioned as order 7 rule 14(3) the same is not applicable to the Commercial Court Act and it is settled principal i.e, mere mentioning of wrong provision does not disentitle the relief to petitioner or order XI authorizes this court to grant leave to the petitioner/plaintiff . Having considering the same this court is inclined to allow the petition and accordingly the petition is allowed and the documents are received subject to proof, relevancy and admissibility.  Stage Of Case Call with I.As.
