Proceedings Summery The present petition is filed under Section 9 of the Arbitration and Conciliation Act,1996 with a prayer to (a) direct the respondent No.1 to deposit a sum of Rs.3,55,00,000/- or furnish security before this Hon’ble Court, until the Arbitral Award is passed by the Arbitral Tribunal, (b) in alternative, to attach the immovable properties mentioned in Petition schedule A properties and bank account of respondent No.1 mentioned in Petition Schedule B Bank Account for the purpose of realizing the claim to be filed before the Arbitral Tribunal, (c) direct the respondent to declare and disclose all its un encumbered immovable and movable assets and consequently restrain the respondent from alienating, transferring, mortgaging, encumbering, or creating any kind of third party right or interest of whosoever nature on their assets (movable or immovable) belonging to the respondent or its subsidiary companies, until the Arbitral Award is passed by the Arbitral Tribunal (d) restrain the respondent, her, agents, representative, legal heirs or any person claiming through or under the respondents from selling the balance produce of 32,673 kgs to third parties, which rightfully belongs to the petitioner under the subject agreement.
