Proceedings Summery ment pronounced vide separate one in the open court: In the Result, the suit of the Plaintiff is Decreed in Part with Costs by grating: a) Perpetual Injunction restraining the Defendants by themselves or through their trustees, servants, subordinates, representatives, agents and all other persons claiming under and/or through them from passing off of the Plaintiffs ‘Tea Types’ trademark in any manner by the use of ‘T Types’ and/or any part thereof and/or any other trademark containing the words ‘TEA TYPES’ and/or ‘T Types’ and/or any other trademark......... b) An amount of Rs.38,50,000/- (Rupees Thirty Eight Lakhs Fifty Thousand only) is granted towards damages to the Plaintiff by directing the Defendant Nos. 1 to 3 jointly and severally to pay the same to the plaintiff along with interest @ 9 % per annum on the amount of damages awarded by this court from the date of filing of the suit till the date of realization. c) The rest of the claims of the plaintiff are hereby Dismissed.
