Proceedings Summery The summons sent to Defendant No.3 was served through RPAD. Defendant No.3 called absent and no representation from Defendant No.3. Therefore, the Defendant No.3 is set ex-parte. The record shows that plaintiff has commenced the trial by filing the affidavit in lieu of chief-examination as PW1 and got marked Ex.A1 to A12 before the Principal District and Sessions Judge, Khammam and an advocate commissioner was also appointed for cross-examination of PW1, thereafter the commissioner submitted a report stating that the counsel for defendant filed a memo stating that in view of initiating proceedings under Sec.7 of IBC Act by the State Bank of India before the NCLT, Kolkatta Bench, the defendant cannot proceed with cross-examination of PW1. Thereafter, the matter was transferred to this court.
