Through Video Conferencing: Heard Sri B. Gurudas, learned counsel for the applicant. 2. The applicant is seeking bunching benefit in terms of Rule 7 of CCS (RP) Rules, 2008. It is submitted on behalf of the applicant that the post of Inspector of Posts was granted the pay scale of Rs.7450-11500 with Grade Pay Rs.4600/- as on 24.10.2017. Suddenly, the respondents have re- fixed the applicant’s pay and ordered recovery from his salary. Feeling aggrieved by the same, the applicant has approached this Tribunal, stating that without giving any notice and without following the rule position, the respondents cannot recover the money. In support of his case, learned counsel for the applicant Sri B. Gurudas has drawn my attention to the order of the coordinate Bench at Jaipur wherein it was held that the bunching benefit is taken illegally from the applicant therein. 3. Sri G. Rajesham, learned Standing Counsel took notice on behalf of the respondents and opposed the interim relief. He sought four weeks time for filing reply. 4. After hearing both sides and in view of the above circumstances, I am of this view that there is a prima facie case made out for interim relief. Hence, the respondents are hereby directed not to make any recovery from the salary of the applicant or effect reduction of pay of the applicant till the finalization of this Original Application. 5. ADMIT. List the matter on 17.02.2020 before Registrar’s Court for completion of pleadings.
