Heard Mr K.Sudhaker Reddy, learned counsel for the applicant and Mrs G.Manjula, learned Standing Counsel for Respondents.

2.       The applicant's qualifying service for the purpose of granting provisional pension was calculated after taking into consideration the period of suspension.  Under the Rules, the applicant is entitled for 100% of the pension excluding the gratuity.  Basing on the said calculation, the applicant was granted Provisional Pension of Rs.25,300/-.  However, subsequently by order dated 12.09.2017, the 2nd Respondent reduced the pension to Rs.20,000/-.  Though the Respondents counsel submits that granting Provisional Pension at the rate of Rs.25,300/- was an inadvertent mistake, no sufficient reason was assigned for reducing the pension.  Moreover, the Provisional Pension was reduced without notice to the applicant. Therefore there shall be interim suspension of the order dated 12.09.2017 where under the applicant's Provisional Pension was reduced.
