Heard Dr. A. Raghu Kumar, learned counsel for the applicant.

2.  ADMIT.  Smt. K. Rajitha, learned Senior Standing Counsel took notice for the respondents and advanced her arguments.

3.  The applicant was proceeded in a disciplinary case for negligence in dealing with the retirement of a Grameena Dak Sevak.  The respondents have imposed a penalty of recovery of around Rs.1,08,093/- from the salary of the applicant.  The contentions of the applicant are that he is nowhere connected with the case.  Besides, the incident took place in the year 2005 whereas the action has been initiated by the respondents in the year 2019.  The applicant has pointed out that there are discrepancies in the charge memo itself.  He has also contended that principles of natural justice have not been followed.  

4.  Learned counsel for the respondents has submitted standing instructions received from the respondents.  We have gone through the same as well.

5.   In view of the above, we find that the applicant has made out a prima facie.  Hence, respondents are directed not to make any further recovery from the salary of the applicant till the O.A. is heard and disposed of.  

6.   Respondents are granted four weeks time to file reply.  List the matter on 28.01.2021 before Registrar's Court for completion of pleadings.
