Heard Sri M. Venkanna, learned counsel for the applicant, Smt M. Swarna, learned Standing Counsel for the respondents and Sri B. Gurudas, learned counsel for the Private Respondents No.4 to 10.

2. The applicant, consequent to restructuring of Postal Assistant cadre, was promoted to LSG cadre and was posted to Sangareddy. The respondents have filed standing instructions where they state that the directions given by this Tribunal in OANos.515/2018 & 517/2018 were fully complied and that the relevant rules have been followed.  However, it has been contended by the Ld. Applicant counsel  that the juniors to the applicant have been retained at Hyderabad GPO whereas the applicant, who is senior has been transferred from Hyderabad and posted to Sangareddy.  Usually, when the transfers are affected, it is the junior who is moved but not the senior. The standing instructions filed by the respondents do not contain any response to this contention.  

3. Sri B. Gurudas, learned counsel for the private respondents has submitted that the applicant is not senior to the private respondents and any interim relief granted to the applicant would adversely affect the interest of the private respondents.

4. Ld. Counsel for the respondents submitted that the orders of transfers were issued to a large number of employees and hence any interference would upset the entire chain of transfers and that the promotion and transfer orders issued were consequent to the orders of the Tribunal in OAs cited supra.

5. After hearing the counsel, as an interim measure,  the transfer of the applicant to Sangareddy on promotion,  is temporarily stayed till the OA is disposed of. We also make it clear that the status/position of  the private respondents, as is prevailing on date, will not be disturbed  till the OA is finally heard and decided.

6. Four weeks time granted for filing reply.

7. List on 30.03.2021  before Registrar’s Court for completion of pleadings.
