Counsel for the applicant present and argues the case of the applicant on the basis of the counter submitted by the Railways before the Hon'ble High Court in WP No.29584/2011. 2. However the learned Standing Counsel for the Respondents submits that since there are two rival claimants for he death benefits, the Tribunal has no locus standi to decide such issues which should be decided by the competent Civil Court. Only after the applicant proves that she was the legally wedded wife of the deceased employee before the competent Civil Court, only then the Respondents can release the death benefits. 3.
