Heard Mr. B. Gurudas, learned counsel for the applicant. 

2.   Admit. Mrs. K. Rajitha, learned Sr Central Govt. Standing Counsel took notice for the respondents and advanced her arguments.

3.    The respondent’s organization have revised the Grade Pay of the Inspector Posts as Rs. 4600/- vide letter dated 24.10.2017.  The pay of the applicant is accordingly fixed vide OM dated 30.8.2008 as per Rule 7 of CCS (RP) Rules, 2008.  After fixing the pay, the General Manager (Finance), Vijayawada directed revision of pay of the applicant, proposing a recovery of Rs.12,78,458/- from the pay of the applicant.  The grounds taken by the applicant are that recovery is ordered without issuing any notice and also that the Rule claimed by the respondents is not applicable to him.  It has to be applied to the employees who have joined recently is the claim of the applicant.  It is further claimed by the applicant that the bunching benefit  has been irregularly denied to him.  He has also stated that the other Benches of this Tribunal namely Jodhpur, Ernakulam & Gauhati  have granted relief in similar cases.

4.   In view of the above submissions, we direct the respondents not to effect recovery from the pay of the applicant till the O.A. is disposed of. Learned counsel for the respondents submitted that the applicant is going to retire in 7 months.  She is advised to ensure that the reply is filed within four weeks and make a mention before the Bench for final adjudication of the matter.
