Through Video Conferencing: Heard Smt Anita Swain, learned counsel for the applicant. 2. Admit. Sri V. Vinod Kumar, learned Senior Central Government Standing Counsel takes notice for the respondents and sought time for filing reply. 3. The applicant has been granted two additional increments based on the orders of Hon’ble High Court of Kerala on 18.01.2007. The matter was also contested in the Hon’ble Supreme Court and the SLP was dismissed. The respondents issued order, granting two additional increments to the applicant. After implementation of the recommendations of 7th CPC, the pay of the applicant was not fixed, by considering the two additional increments. Besides, the respondents have issued the OM dated 03.08.2020 to discontinue grant of two increments and also they have started recovery from the salary of the applicant at the rate of Rs.24,597/- per month. The contentions of the applicant are that no notice was issued for recovery of the amount. Besides, the orders of the superior judicial forums have been violated by the respondents. 4. In view of the above, a prima facie case has been made out by the applicant. Hence , the respondents are directed not to make any recovery from the pay of the applicant till the OA is decided. 5. Four weeks time is granted for filing reply. 6. List the case on 23.11.2020 before Registrar’s Court for completion of pleadings.
