DAILY ORDER

  1. M.A. No.60/760/2017 has been filed under Rule 4 (5) (a) of Central Administrative Tribunal (Procedure) Rules, 1987 for permission to the applicants to joint together and file the single application.  The same is allowed.
  2. M.A. stands disposed of.

  2. Learned counsel for the applicants submitted that earlier also applicants had approached this Tribunal by filing O.A. No.060/01195/2015, which was decided vide order dated 24.8.2016, whereby impugned orders therein were set aside with direction to the respondents to pass a fresh reasoned and speaking order in accordance with law after affording the opportunity of hearing to the applicants.  He submits that subsequently, the respondents issued show cause notice dated 14.09.2015 (Annexure A-11), without there being any justification for their action.  Now they have passed the impugned order 08.11.2017 in the same fashion, which has already been rejected by this Court.  Therefore, he submits that the order is band in law.
  3. Issue notice to the respondents for 03.07.2017.
  4. Meanwhile, respondents are restrained from effecting recovery from the applicants.
