DAILY ORDER

This is a DB matter.  As the single member  can deal with the matter of granting interim order, I have taken up the matter for grant of interim relief as prayed for in the O.A.

The case of the applicant is that he has been issued with a charge sheet dated 02.08.2016 on the ground that he had submitted a false OBC  community certificate to secure employment in the respondents organisation.  The applicant contends that the respondents  got the community certificate  verified by the Tehasildar on their own without any intimation to him and on the basis of the report submitted by the Tehasildar, a charge sheet was issued to him.  The ld. counsel for the applicant submits that for cancellation of caste certificate there is a laid down procedure under the Rules and the respondents have not followed the said procedure before proceeding further in his case. 

The impugned Charge Memo is issued to the applicant to hold inquiry under Rule 14 of the CCS (CCA) Rules, 1965 and the charge is framed by invoking provision of  under Rule 3 (i) (iii) of CCS (Conduct) Rules, 1964. 

To the question raised by the Court whether  he has availed the channel of redressal is available to him,  the learned counsel replied that no such provision is available under the rules except approaching this Tribunal.  

On the basis of the above information and considering the material placed before me, I am inclined to grant the interim relief as prayed for in the O.A.  Accordingly,  respondents are directed not to conduct further proceedings pursuant to the charge Memo dated 2.8.2016 till filing of reply statement.
