Dr. A. Raghu Kumar, learned counsel for the applicant present  Mr.V. Vinod Kumar, learned Sr.CGSC represents Respondents

Dr. Raghu Kumar, learned counsel for the applicant submits that the impugned Annexure A-I charge memorandum dated 16.01.2015 has been issued by an incompetent authority as the applicant is a Group-A Officer, for whom the Disciplinary Authority is President of India.He argued that the chargememo issued by the Secretary to Govt of India is not sustainable on this ground and he also prays for stay of further proceedings in pursuance of charge memo by way of interim relief.

Mr.V. Vinod Kumar, learned Sr. Central Govt., Standing Counsel for Respondents, on the other hand submits that the applicant can very well raise this ground before the Inquiry Officer  and there is no need to interfere with the charge memorandum at this stage.  

Having regard to the submissions made by both the counsels, I am not inclined to grant interim relief as prayed for.  Further, the Respondents are directed  to continue with the proceedings in pursuance of the charge memo.  However, no final order shall be passed on the Inquiry Officer's report without leave of this Tribunal.

Six weeks time granted for filing reply.  Post on 01.08.2017.
