Notice. Ms. K. Rajitha, Sr. CGSC takes notice for Respondent No. 2. It is the case of the applicant that he has been promoted from Group-C to Group-B as Assistant Accounts Officer. As the latter cadre carries all India transfer liability, the cadre controlling authority posted the applicant along with other similarly situated officers to Circles other than the Circle where they posted. Accordingly, the applicant was posted from Telangana Circle to DoT Headquarters at Delhi. He made a representation against the same and requested that he may be continued in AP Circle. However, this was not acceded to as reflected in respondent letter dated 11.5.2017. The applicant says that he has not been relieved to date. The grounds on which the applicant is seeking that he may be retained in Telangana Circle is that he has crossed 57 years of age and being a native of Telangana and with two and half a year of left over service, posting him at a far away place is not fit and proper. Further, his wife is working in DoT in Hyderabad. The third ground is that he belongs to SC community and there is a special dispensation for this community in matters of inter circle transfers. The applicant has also indicated that there a number of vacancies in Telangana Circle where he could be accommodated. On basis of aforementioned facts and circumstances, I am inclined to grant status quo as it obtains today in respect of the impugned orders in so far as the applicant is concerned till such time the respondents file their reply statement. List on 13.7.2017 for reply. |
