Issue Notice.

Mr. A. Radhakrishna, Additional Central Government Standing Counsel takes notice on behalf of the respondents.

Heard the extensive arguments on both the sides for and against the grant of interim stay of the impugned order vide which the applicant stands transferred to Leh.

As the time is of real essence in view of the fact that the applicant will be relieved by 8th June, 2017 and he will have to join his new posting at Leh by 23.6.2017. 

The Ld. counsel for the respondents stated that he would get instructions by tomorrow.  The instructions inter alia shall contain the following information:-

a) Whether the procedure as laid down was followed by the Committee constituted to give a final decision on the representation received from the employee concerned.

b) The Minutes of the said Committee in which the Committee examined and decided the cases of those  who made representations.

c) The processing of posting proposal as per para 31 of OM dated 9.10.2015 marked as A-7, with reference to the applicant as also of the others of his rank who had submitted representations, along with their duly filled in form by Respondents.  

The above information is illustrative.  The respondents would like to give all other relevant information specially in view of the fact that the applicant did not receive any response to his representations and also that the impugned order dated 30.5.2017 is not a speaking one with the result the Court is unable to know the grounds on which the respondents rejected his representation.

Till such time the above information is received, there shall be an interim stay on the operation of the impugned order dated 9.5.2017.

Post the matter on 7.6.2017.
