    Heard Shri A.L.Sharma, learned counsel for the applicant.

     Perused the pleadings and the documents annexed thereto.

   Shri A.L.Sharma, learned counsel for the applicant submits that the issue involved in this OA is squarely covered by the order of this Tribunal dated 28.04.2017 in OA No.118/2017.

     Having regard to the cause of action and the nature of the relief sought by the applicant in this OA, in exercise of the powers conferred upon the Tribunal under sub-rule (4) of Rule 11 of CAT (Procedure) Rules, 1987, I direct Shri Joy Mathew, the learned standing counsel for Navodaya Vidyalaya Samiti to take notice on behalf of the respondents and to make his submission.

     When a specific query is put to Shri Joy Mathew as to why the present OA can not be disposed of in terms of the order dated 28.04.2017 in OA No.118/2017, he submits that the notice may be issued to the respondents on the OA and they be granted some time to file their objection. But, on perusal of the pleadings and the documents annexed thereto, I am satisfied with the submissions of Shri A.L.Sharma, learned counsel for the applicant that issue involved in this OA is identical to that of the one in OA No.118/2017, which was disposed of by the order dated 28.04.2017. Therefore, I am of the opinion that issuance of notice will serve no purpose.  Hence, the OA is disposed of in terms of the order dated 28.04.2017 in OA No. 118/2017 by a separate order.
