Present :  None for applicant. 

         Ms.M.M.Bhatt, counsel for respondents. 

   Learned counsel for the respondents submits that neither applicant nor his counsel has put appearance and it seems that  applicant is having no interest to pursue the OA. She also contended that this OA has lost its sanctity also because the OA was against order of transfer and presently applicant has sought VRS and has been relieved from service after grant of VRS.

2.     Considered the submissions. Record reflects that the applicant, an officer of Indian Revenue Services (IRS) cadre while working with Income Tax Department as Assistant Director (Training), Regional Training Institute, Ahmedabad was transferred to Rajasthan, vide Annexure A-1 of OA and being aggrieved by said transfer Order he  preferred instant OA. During pendency of the OA,  applicant applied for VRS, has been granted VRS, vide Order No.A-38012/23/2018-dated 31.07.2018 and has been relieved from service w.e.f. 10.08.2018. On last date of hearing, it was pointed out to as to what, except academic discussion lies now in the OA but  learned counsel for applicant  requested to consider the matter regarding  drawl of pension  from Ahmedabad. As there is no pleadings in the OA nor the same could be on issue of drawl of pension hence it was suggested to take appropriate steps in appropriate form however, upon insisting by counsel for applicant that he wants to check this aspect, the OA was kept pending for today.

     As noted above, applicant or his counsel is not present today so, taking note of entirety; the OA is dismissed for non prosecution as well being infructuous.
