DAILY ORDER

Counsel for the applicant stated that this is a 2nd round of litigation and the respondents have erroneously  given 28 points  for assessment of indigent condition for compassionate appointment whereas the applicant deserves more points in respect of a) number of dependents (because the married son is residing along with family). b) for katcha house 3 extra marks needs to be granted.  c) for income calculation.  According to the counsel for the applicant states that the applicant is entitled 44 points.

Counsel for the respondents argued that there is no discrepancy with reference to the marks awarded since i)  married son is staying separately, and (ii) discharge benefits of  more than Rs.1,50, 000/- have been paid. iii) the Tahsildar Certificate has been taken on record for income.

Since the above submissions are questions of fact, the counsel for the respondents is directed to produce documents regarding these points on the next date of hearing.
