Heard Sri K. Sudhaker Reddy, learned counsel for the applicant.

2. The present case pertains to enhancement of retirement age from 58 to 60. The same issue fell for consideration before the Tribunal on 04.06.2020 and the interim prayer of the applicant therein to continue him in service was declined by the Bench with the following observation:

“5.   We, prima facie, find that the Award in CR No.151/2007 by the Central Government Industrial Tribunal-Cum-Labour Court at Bangalore, was for enhancement of age of retirement from 55 years to 60. A Writ Petition is said to be pending against it. The fact remains that in the interregnum, the age of retirement was enhanced to 58 years. The question as to whether this was through any settlement or unilaterally by the Government, and if so, the impact of the Award on it needs to be examined.”

3. In order to maintain judicial discipline and consistency, Tribunal has to abide by the observation of the Co-ordinate Bench which de-facto is well settled fact of law. Accordingly, the  interim relief sought is declined.

4. Issue notice to the respondents. Respondents are granted four weeks time to file reply.  List the matter on 15.07.2020. Any steps taken in the meanwhile shall be subject to further orders.
