DAILY ORDER

      Ms. Prachi Upadhyay, learned counsel for the respondents produces a copy of the order of the Hon'ble High Court of Gujarat dated 16.06.2017 in SCA No. 9780/2017.  She draws my attention of paragraph 7 of the said order dated 16.06.2017. It reads as under :

"7. Considering the fact that ad interim order passed by this Court on 10th May 2017 in the present writ petition has been continued till today and it is reported that the next date of hearing before the learned Tribunal is 28th June 2017, the present Special Civil Application is disposed of by continuing ad interim relief granted earlier on 10th May 2017, till the prayer of the petitioner for interim relief is considered by the learned Tribunal. However, it is made clear that the learned Tribunal shall pass appropriate order in accordance with law and on merits in respect of continuation of protection or not. Therefore, the learned Tribunal may consider the question for grant of interim relief without in any way being influenced by the present order."

    In view of the above order, it is necessary for this Tribunal to consider continuation of protection granted by the Hon'ble High Court of Gujarat vide its order dated 10.05.2017 in SCA No.9780/2017.

      Ms. Prachi Upadhyay, learned counsel for the respondents points out that the respondents have already filed their reply.

       Ms. H.R.Balodi represents Shri A.L.Sharma, learned counsel for the applicant submits that rejoinder is also filed.

       In view of the fact that pleadings are complete, the matter may be finally disposed of.  It is the Division Bench matter. Hence, Registry is directed to place the matter immediately before the Division Bench on the top of the list, as and when, it meets. It is made clear that protection granted by the Hon'ble High Court of Gujarat vide order dated 10.5.2017 in SCA No.9780/2017 shall continue to be in operation till further orders.
