    Heard both counsel.

2. Applicant is an IAS officer who stood 11th in the All India merit list.  On her request, she has been allotted to the erstwhile Andhra Pradesh State.  Prior to bifurcation of the State of Andhra Pradesh she was placed under suspension. During the period of her suspension, respondents have processed the cases of IAS officers for cadre allotment to the State of Andhra Pradesh post bifurcation.  Applicant being under suspension, could not exercise the option for considering her case to be allotted to the State of Andhra Pradesh and hence is presently working for the State of Telangana. 

3.   Learned counsel for applicant states that there was no scope for her to apply for allotment during suspension and therefore she has approached this Tribunal at this juncture of time.  Besides, rules provide for considering the cases of officers for cadre allotment as and when eligible under the relevant provisions.  Cadre allotment to a State is a constitutional right which cannot be infringed upon, is one another contention of the learned counsel for the applicant.  Moreover, the applicant is reported to have been physically immobilised on medical grounds which prevented her to approach the Tribunal in time.  Applicant's emphatic submission is that, denying the applicant to work in a cadre to which she is legally entitled to is a continuous cause of action, which thereby does not attract provisions of limitation. In view of the aforesaid reasons, not registering the OA may cause irreparable injury to the cause of the applicant and hence in the interest of justice, Registry to register the OA. 

4.  Issue notice to respondents.  Four weeks time granted to respondents for filing reply statement.  

5.   Case be listed on 22.04.2020.
