Counsel for the applicant submits that as per the directions issued by this Tribunal in OA No. 333/2018, decided on 15/07/2019, the deceased husband of the applicant had submitted relevant details of bank account for the purpose of consideration for grant of compassionate allowance before the office of respondents. However, vide impugned decision dated 19/09/2019 the respondent rejected the claim for grant of compassionate allowance on the ground that the records of DAR proceedings initiated against the deceased employee i.e. Shri. Pravin Naranbhai, Ex Khalasi (CNW) under CDO-ADI (MG Rajkot) as well as service records are not traceable by the department and the claim of compassionate allowance is being filed at a belated stage, the same has been rejected. Hence this OA. Issue notice on MA No.230/2021 (for Condonation of Delay) as well as on the OA returnable by 24/08/2021. Respondents are directed to file their reply within four weeks and applicant is at liberty to file rejoinder if so desires, within two weeks thereafter.
