The applicants, 14 in number, and working as Postal Assistants in the Telangana Postal Circle Office at Hyderabad, filed the O.A. questioning the Annex.A-II Office Memorandum dated 5.10.2016 in distributing various categories of posts (excluding Stenographers) between the Residuary Andhra Pradesh Postal Circle Office and Telangana Postal Circle Office (includes the component for Hyderabad City Region) and the consequential Memorandum dated 15.2.2017 (Annex.A-I) in relieving the applicants from Telangana Circle to enable them to report at A.P. Circle, Vijayawada.
- Heard Mr. M. Venkanna, learned counsel for the applicants and Mrs. K. Rajitha, learned Senior Standing Counsel for the respondents.
- The learned counsel for the applicants submits that the distribution of various categories of posts between the two Circles itself is illegal and that the consequential relieving orders of the applicants and also the scheme of distribution of posts are against the various instructions of the Government and accordingly prays for keeping the impugned orders in abeyance, pending the O.A. Whereas the learned counsel for the respondents submits that the distribution of posts was done way back in October, 2016 and even the applicants were relieved on 15.2.2017 itself and hence the same cannot be interfered at this stage. The learned counsel further submits that in view of non-reporting of the applicants at the Vijayawada Circle, the work is suffering due to the number of vacancies in the said Circle and consequently the public interest is also suffering. Accordingly, she opposes the granting of any interim orders.
- In the circumstances and since the applicants have already been relieved more than a month back, we are not inclined to grant any interim order. However, the joining of the applicants at Vijayawada Circle is subject to the result of the O.A. and shall not affect their rights in the O.A.
- List the matter on 28.4.2017. The respondents shall file their counter before the said date.
