The applicant is the sole surviving dependent of the deceased employee. It is not disputed that the applicant is the recipient of the family pension as well as other DCRG claims. If the court intervenes it will amount to considering the family pension as inadequate for the sustenance of even the sole survivor. This case not be logically acceptable hence, the O.A. is being dismissed for no cause of action.
